MZD Legal Consultancy (“MZD”) with the URL, www.mzdlegal.in (“MZD Website”) is a platform that offers information about the firm, publishes articles for general public consumption, and allows for visitors to contact MZD through the website. The MZD Website is operated and managed by MZD Legal Consultancy, having its principal place of business at 716, Tulsiani Chambers, Free Press Journal Road, Nariman Point, Mumbai - 400021, India.
This Privacy Policy, sets out the basis on which any Personally Identifiable Information that MZD collects from you, or that you provide to MZD, will be stored, processed, used, preserved and/or shared with third parties.
Upon accessing the MZD Website and prior to submitting information, you must carefully read, understand and accept the terms of this Privacy Policy. This Privacy Policy constitutes a contract between MZD and you.
Definitions & Interpretations:
Capitalized terms set forth in this Privacy Policy and not otherwise defined will have the meaning ascribed to them under this clause.
‘Cookie’ refers to a small text file that is stored on Your computer / browser / local system or any device through which the MZD Website is accessed, that tracks and stores information to enable MZD to recognize You when You visit the MZD Website. ‘Force Majeure Event’ refers to any event that is beyond the reasonable control of MZD and will include, without limitation, acts of government, computer hacking, unauthorized access to computer data and storage devices, computer crashes, breach of security etc.

‘Pixel Tag/ Web Beacon/ Clear GIF’ refers to a small graphic with a unique identifier, embedded invisibly on a webpage, which is used to count or track activities on a particular webpage and/or ad impressions and/or clicks, as well as to access cookies stored on Your computers / browsers / local systems or other devices from which the MZD Website is accessed.
‘Privacy Policy’ refers to this Privacy Policy including any amendments as may be updated from time to time.
‘You’ / ‘Your’ refers to any person who for themselves or on behalf of any other person, accesses the MZD Website for purposes which may include without limitation, browsing or viewing information made available on or through the MZD Website; submitting queries or information through the MZD Website; or otherwise using the MZD Website in any manner whatsoever.
Unless the context otherwise requires:
the headings are used for convenience and ease of reference and are not to be construed in the construction or interpretation of any provision of the Privacy Policy;
unless stated otherwise the words ‘include’ and ‘including’ will be construed without limitation;
words importing persons will be deemed to include natural and juridical persons i.e. individuals, incorporated and unincorporated entities; and

MZD uses Cookies, Pixel Tags, Web-Beacons, flash cookies and similar files or technologies to obtain certain information, including the internet protocol (IP) address used to connect to Your phone or tablet to the internet, Your login information, browser type and version, time zone setting, browser plug-in types and versions and operating system.
Information about Your visit, including clickstream to, through and from the MZD Website (including date and time); information viewed or searched for; page response times, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page;
Information contained in the interaction that may take place between MZD and You through emails and/or through push or online messaging channels.
Any such information as may be necessary to facilitate use and display of the MZD Website and to enhance user experience.
Purpose and Usage of Information:
MZD collects and processes information as submitted and collected under this Privacy Policy for responding to Your queries when You contact or communicate with MZD.
MZD will be compelled to disclose Your information, as collected in accordance with the Terms, to a third party if it is under a duty to disclose or share such information in order to comply with any order or legal obligation, under any law, or in order to enforce or apply the Terms of Use, or to protect Your rights or the rights or safety of MZD, or others. This includes disclosing information to Government agencies, other companies and organizations for the purposes of prevention, detection and investigation of fraud including cyber related crimes.
Consent to collect and process information:
You, by engaging in any manner with the MZD Website, expressly consent and grant permission to MZD and/ or its representatives:
to use, collect and process Your information, as submitted and collected in accordance with the Privacy Policy and in the manner and for the reasons as provided under the Privacy Policy.
to share and transfer Your information, as submitted and collected in accordance with the Privacy Policy, with any third party.
MZD reserves the right to make changes to the Privacy Policy without any express and specific intimation to You. Your continued use of the MZD Website will constitute Your consent and acceptance of such updated terms of the Privacy Policy.
You guarantee that the information submitted by You to MZD is in all respects complete, accurate and true. You are solely responsible for the authenticity and correctness of the information provided by You.
Your Rights:
In relation to Your information, collected by MZD in accordance with the Terms, You have the following rights:
Right to confirmation and access: You have the right to obtain information and/or confirmation, with respect to the processing of Your information, collected in accordance with the Privacy Policy, from MZD.
Right to correction and erasure: You are responsible to notify MZD of any inaccuracy in information provided by You under the Privacy Policy and seek correction or erasure of such information.
Right to be forgotten: You have the right to restrict or prevent the continuing disclosure of the Your information to and by MZD and You must notify MZD of the withdrawal of Your consent from allowing MZD to collect, store, process or otherwise use Your information in relation to the Privacy Policy.
These rights can be enforced by You by addressing to the Grievance officer in the manner as provided under the Grievance Redressal mechanism of the Privacy Policy.

Security Precautions:
The Privacy Policy governing the usage of Your Personally Identifiable Information by MZD is subject to applicable laws.
MZD follows generally and commercially accepted, appropriate electronic, and managerial procedures to safeguard and help prevent unauthorized access to Your information, as submitted and collected in accordance with the Privacy Policy and to maintain data security. These safeguards take into account the sensitivity of the information that MZD collects, processes and stores and the current state of technology. MZD’s security measures may be reviewed and updated in terms of technological advances.
MZD assumes no liability or responsibility for disclosure or leak of Your information due to errors in transmission, unauthorized third-party access, or other causes beyond MZD’s control.
Notwithstanding anything contained in the Privacy Policy or elsewhere, MZD will not be held responsible for any loss, damage or misuse of Your information, as collected in accordance with the Privacy Policy, if such loss, damage or misuse is attributable to negligence on Your part, or on part of any third-party or a Force Majeure Event.
Governing laws and Disputes:
The law governing the Privacy Policy will be the substantive laws of the Republic of India, without giving effect to the conflict of law principles of any other jurisdiction from which the MZD Website may be accessed.
Any dispute arising out of or in connection with the Privacy Policy, including any question regarding its existence, validity or termination, will be referred to and finally resolved by arbitration. The seat and venue of the arbitration will be Mumbai, India. The Tribunal will consist of one arbitrator, appointed by the parties mutually. The language of the arbitration will be English. The law governing this arbitration agreement will be the Arbitration and Conciliation Act, 1996 (as amended and re-enacted at the relevant time).
Miscellaneous:
The forbearance by MZD to enforce any provisions of the Privacy Policy will not constitute a waiver of any right under the Privacy Policy or of any subsequent enforcement of that or any other provisions. If a court of competent jurisdiction holds any provision of the Privacy Policy invalid or unenforceable, the remaining provisions of the Privacy Policy will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law.

You may address grievances and / or complaints and/or requests at info@mzdlegal.in. MZD is available to address grievances between 11:00 A.M. to 5:00 P.M. from Monday to Friday except public holidays. MZD will endeavour to address Your grievances within a period of 36 hours from the receipt of Your email.
